ORDER
  

Ms. Tanu Jain, a person with 50% locomotor disability vide her complaint dated 15.01.2021 submitted that she had applied for Post Code 02/17 (DASS, Grade-IV) in PH-OH category. She had qualified Tier 1st exam and when she appeared for Tier 2nd exam (typing/skill test) on 26.12.2020 she was given exemption by exam Incharge from appearing in skill test after checking her permanent Physically Disability (50%) Certificate No. 2467/11 dated 29th June, 2011.  In addition, she had also given an application requesting exemption from appearing in Typing Test to DSSSB.  However, she was shown as disqualified in spite of fairing well in merit list on the ground that a particular Disability Certificate was not submitted. Infact, the last candidate with disability scored 101.66 marks and her score was 109.28 marks. On enquiry from DSSSB about her disqualification, she was told to submit another certificate in a new format and when she submitted the same on 22.12.2020 (in original), DSSSB has not considered her case.  There is hardly any difference between the two.

2. The complaint was taken up with the respondent vide SCN-Cum-Hearing Notice dated 03.03.2021 and a hearing was scheduled on 15.03.2021.

3. During the hearing, complainant appeared alongwith her family members and reiterarated her written submissions.  Sh. V.P. Jha, Dy. Secretary, CC-II appeared on behalf of respondent and submitted a copy of their reply dated 12.03.2021.  Copy of the same was also  given to the complainant. 

4. Sh. V.P. Jha, Dy. Secretary, CC-II stated that for seeking exemption from skill / typing test, candidate was required to give a certificate from Medical Board attached to Special Employment Exchanges for the Persons with Disabilities (or by a Civil Surgeon where there is no such Board) stating that she is unable to type at Skill Test Centre on the date of skill test i.e. 26.12.2019, but she did not submit the same at that time. Therefore, her request for seeking exemption was rejected by the Board vide Order No. 1041 dated 08.09.2020.  

4. After deliberations and discussions with the respondent and complainant, the following are recommended:

(i) DSSSB should take cognizance of the fact that the complainant Ms. Tanu Jain qualified in the merit with 109.28 marks than the candidate with 101.66 marks,  who has been selected and treated qualified while she has been left out.  The reason,   submitted by the DSSSB is about a certificate to the effect of her disability. While the complainant did submit her disability certificate (50% and above), there were slight difference in the format otherwise there is hardly any difference.  However, the same was later submitted by the complainant.  Further, prior to the examination, the exam Incharge at the centre had taken cognizance of her disability certificate and her physical disability and duly exempted her from appearing in the typing /skill test.  Besides, application to the effect requesting exemption from appearing in skill / typing test being a permanent person with disability (above 50%) was  submitted by the complainant. 

(ii) This court is of the view that the case of the complainant be looked sympathetically and with due regard to her qualifying in the merit.  Thus, it is recommended that the candidate should be helped by DSSSB in this regard as most important aspect for a person with disability (that to a girl) is economic independence, which go a long way to grant a meaningful and positive life for the concerned person with disability. 

5. Accordingly the case is disposed off.

ORDER

          The above named complainant, elder brother of Ms. Rubina Sultan a person stated to be suffering from Cerebral Palsy, vide his email dated 01.05.2019 alleged that Mr. Naved Yar Khan, his brother has not taken his sister to the concerned Delhi Govt. Hospital for assessment of Cerebral Palsy and intellectual disability to get a certificate of disability which would help her to register with Niramaya Health Insurance Scheme and apply for Guardianship with the Local Level Committee of the Central Delhi. 

2.      The complaint was taken up with the respondent vide Notice dated 10.05.2019 under the Rights of Persons with Disabilities Act, 2016 hereinafter referred to as the Act and the case was fixed for hearing on 23.07.2019.

3.      On 23.07.2019  complainant, Sh. Hayat Yar Khan informed about his inability to attend the hearing as he is in Dubai, UAE and authorised Sh. Deepak Sharma Advocate to present his case.      

4.      Sh. Naved Yar Khan, the Respondent in his reply inter-alia submitted that Ms. Rubina Sultan is not a resident of Delhi as she is residing in Ghaziabad with him and hence the State Commissioner for Persons with Disabilities, Govt. of NCT of Delhi had no jurisdiction.  He informed that he is not able to attend the hearing due to illness.

5.      The parties were directed vide record of proceedings dated 23.07.2019 to submit the relevant documents like Voter ID, Aaadhar card, Pan card, Ration card etc. or any other valid residence and identity proof in support of their respective contentions about the residence of Ms. Rubina Sultan by 31.07.2019 and the case was adjourned to 09.08.2019.

6.      Vide his email dated 09.08.2019 Mr. Naved Yar Khan sought exemption from appearance  on that day and submitted that he would be producing public documents to establish that his sister Ms. Rubina Sultan is in his custody at his house in Ghaziabad since 2012.

7.      Sh. Deepak Sharma, Advocate for the complainant produced the copies of Electoral Roll of A.C. Ballimaran, Delhi for the years 1994 and 1999 in which the name of Ms. Rubina sultan appears.  He also produced a copy of the Election ID Card from the court record which the respondent himself had filed, a copy of letter dated 31.07.2012 from National Highways Authority of India addressed to Ms. Rubina Sultan and a copy of an appeal filed at Tis Hazari Courts by the respondent against the order dated 12.03.2015 on an application in which the respondent Mr. Naved Year Khan and Ms. Rubina are appellants.  In all those documents, the address of Ms. Rubina Sultan is 5182, Ballimaran, Delhi and these indicate that she was residing at Ballimaran till 2016.  The fact that she is the owner of the property at 5182, Ballimaran is also not disputed.

8.      The limited issue with which this court is concerned is that Ms. Rubina Sultan who is stated to be a person with Cerebral Palsy must be produced before an appropriate certifying authority and if eligible, should be issued a valid certificate of disability.  Since as per the documents produced, she is a resident of Ballimaran, Delhi, the medical authority in Delhi would be the competent certifying authority and to issue the certificate of disability.  However, if she has the required documents, the medical authority in Ghaziabad can also assess her and issue the certificate of disability which is the sole purpose of taking up the complaint. The resistance to do so by the respondent is unreasonable and can attract the penal provisions of the Act.

9.      The respondent was given last opportunity to make submissions before this court and arrange assessment of Ms. Rubina Sultan for assessment of her disability and issuance of a certificate of disability if she is eligible for the same vide RoP dated 13.08.2019.

10.    During the hearing on 12.09.2019,  Sh. Deepak Sharma, Advocate appeared for the complainant and submitted a copy of passbook of Bank of India and another passbook of the Post Office in respect of Ms. Rubina Sultan both of which show her address at Ballimaran, Delhi-110006.  He also submitted that the documents emailed on 31.07.2019 by complainant to this Court, may also be taken on record.  He also submitted that the complainant may be informed at least 2 weeks before the date of examination of Ms. Rubina Sultant for assessment of disability so that he and his representatives can also be present during her examination. 

11.    The respondent sent a list of documents which contain a copy of e-MO (Payment)  of Rs. 500/- of Department of Posts sent by Post Office Chandni Chowk, Delhi to Ms. Rubina Sultan C/o Naved Yar Khan, H.No. 2346, Crima Tawar, Mahagul, Mascot, Crosing Republic Dhundhera, Ghaziabad and a copy of Suit No. 53/2012 of the complainant in which it has been mentioned that the plaintiff therein namely Mr. Naved Yar Khan and Others (including Ms. Rubina Sultan) have shifted to Flat 2346, Crema tower, Mahagun Mascot, Crossing Republic, NH-24, Dhundhera, Ghaziabad -201009.  However neither he himself appeared nor did he send anyone to represent him on 12.09.2019.

12.    This Court has no issues whether Ms. Rubina Sultan is examined for assessment of her disability and issued a certificate of disability, if eligible by a certifying authority in Delhi or in Ghaziabad. 

13.         In the light of the above, respondent is once again directed to produce Ms. Rubina Sultan before the competent certifying authority  in the hospital having the jurisdiction and apply for issuance of disability certificate to her within one month from the date of receipt of this order and intimate the complainant the proposed date, place  and time where he would produce Ms. Rubina Sultan for assessment and certification of disability so that the complainant or his representative can also be present in the concerned hospital as requested by him.   After Ms. Rubina Sultan is assessed for disability and a decision is taken by the concerned certifying authority to issue the certificate of disability to her or otherwise,  the respondent shall intimate this Court and the complainant within a week thereafter.  If the complainant does not receive any intimation by 15.11.2019, he may approach the State Commissioner for Persons with Disabilities, Uttar Pradesh, Rajkiya Drishtibadhit Chhatron ka Chhatrawas, Basic Siksha Nideshalaya Campus, Nishatganj, Lucknow, Uttar Pradesh, Email: info@commissionerdisabilitiesup.in  with the request to direct the respondent to have Ms. Rubina Sultan examined by the Medical Authority in Ghaziabad  for issuance of disability certificate as the respondent has also raised the issue of jurisdiction on the ground that she is residing at Ghaziabad. 

14.         The complainant may also approach the concerned Special Court designated under Section 84 of the Act for trial of offences under the Act. 

15.         Respondent is informed that in case of non-compliance of the order, he may run the risk of being punished under Section 89 of the Act which provides as under:
              “Any person who contravenes any of the provisions of this Act, or of any rule made thereunder shall for first contravention be punishable with fine which may extend to ten thounsand rupees and for any subsequent contravention with fine which shall not be less than fifty thousand rupees but which may extend to five lakh rupees.”

16.      The case is disposed of.

The above named complainant, a person who has claimed to have 75% visual disability by birth, filed a complaint dated 17.09.2019 under Section 75 of the Rights of Persons with Disabilities Act, 2016 (the Act) to set aside the office order dated 16.09.2019 of Delhi Public School, R.K. Puram relating to finalization of his dues on attaining the age of superannuation, i.e. 60 years on 20.09.2019 and grant of extension of service to him for 2 years after the date of his superannuation.
2.       Vide his letter dated 23.09.2019, the complainant has requested to withdraw his complaint with liberty to institute appropriate legal proceeding to seek remedy for his grievances as may be available to him under the law.    
3.       While the complaint is dismissed as withdrawn, it is observed that a copy of an unsigned and incomplete certificate dated 19.07.2012 without indicating the percentage of his visual disability on the letter head of Dr. Rajendra Prasad Centre for Ophthalmic Sciences, All India Institute of Medical Sciences Ansari Nagar with the name of Dr. Tushar Agarwal written at the space for signature of the Doctor, has been annexed at Annexure-C1 to the complaint. 
4.       It is also observed that Section 75 of the Act pertains to the functions of the Chief Commissioner for Persons with Disabilities and not the State Commissioner for Persons with Disabilities.
5.       Medical Superintendent, Dr. Rajender Prasad Centre for Ophthalmic Sciences, All India Institute of Medical Sciences, New Delhi is requested to intimate this Court by 4th October, 2019 whether the certificate dated 19.07.2012 (copy enclosed) is registered by the Centre and provide details in respect of OPD no. 004224 mentioned in the said certificate for taking further action.

Smt. Neelam Sharma vide her complaint dated 16.05.2018 submitted that her daughter Ms. Shruti Sharma has mental and physical disability.  Ms. Shruti Sharma was under treatment in AIIMS.  She went to nearby Lal Bahadur Shastri Hospital for disability certificate.  They asked her to go to IHBAS as she had earlier visited IHBAS on 10.08.2017, 16.08.2017 and 26.08.2017 and had been examined and investigated for issue of disability certificate by a Neurologist.  Her I.Q. assessment had also been done on 26.08.2017 at IHBAS.  When she went to IHBAS, she was directed to go GTB Hospital who asked her to go back the LaL Bahadur Shastri Hospital.   Harassed by the concerned functionaries of the said three Hospitals for nearly a month, she approached this Court on 16.05.2018. 
2.       As many other persons with intellectual, neurological and other newly added disabilities in the Rights of Persons with Disabilities Act, 2016 had also been undergoing similar experience and getting harassed, this Court requested Principal Secretary, Health & Family Welfare to personally look into the matter and to ensure that the complainant and other persons with disabilities are not harassed further and clear directions be issued to the concerned hospitals to assess and issue disability certificates within a month as required under the rules vide letter dated 23.05.2018. 
3.       Deputy Secretary (Comm.) Health and Family Welfare Department forwarded the representation of the complainant to the Medical Superintendent, Lal Bahadur Shastri Hospital vide letter dated 07.06.2018 and requested to look into the matter and issue a disability certificate in favour of Ms. Shruti Sharma. Deputy Medical Superintendent vide letter dated 29.06.2018 informed Health and Family Welfare Department that the disability Board of Lal Bahadur Shastri Hospital opined that Miss Shruti Sharma has purely neurological disorder and therefore she was referred to IHBAS.  IHBAS neither issued disability certificate to her nor was she referred back to Lal Bahadur Shastri Hospital in 2017.  On 23.03.2018, she visited Lal Bahadur Shastri Hospital on her own and the documents did not show denial of disability certificate or referral back to Lal Bahadur Shastri Hospital.  Therefore, she was advised to follow up at Neurology Department, IHBAS. 
4.       In view of the letter dated 07.06.2018 of Health & Family Welfare Department, Lal Bahadur Shastri Hospital was requested to intimate further course of action to take a final view vide this Court’s letter dated 17.07.2018.  As there was no response, the complainant was contacted on 09.04.2019 and heard on telephone to ascertain the status.
5.       The complainant stated that her 27 year old son is also suffering from Wilson’s disease and is under medication for the last 8 years.  She expressed her concern about the sorry state of affairs in the hospitals which she had visited for disability certificate.  She went and explained her problem to the doctors at RML Hospital who were very considerate and arranged for the assessment and certification of her daughter.  She was issued certificate for 81% multiple disability on 08.03.2019.  She was all praise for the doctors and other functionaries of RML Hospital.  According to her, the concerned functionaries in the Hospitals except RML Hospital were indifferent causing tremendous harassment and mental agony to the entire family. 
6.       She was also quite satisfied with the supportive Janki Devi Govt. Sarvodya Vidyalaya, Mayur Vihar, Phase I, Pocket II, where her daughter Miss Shruti studies.  The school provides appropriate teaching, learning facilities and treats her with sensitivity. 
7.       The complainant requested that strict directions should be issued to all concerned and a policy should be made by Govt. to ensure that no one gets harassed like her and her daughter.  She wondered, if Dr. RML Hospital could do all the necessary examinations, assessments and a team of doctors from the Department of Neurology, Orthopaedics and Psychiatry together could assess Ms. Shruti for her multiple disability and issue a disability certificate, even though she did not fall within the jurisdiction of that hospital, why the same could not be done by other hospitals! 
8.       Incidentally, this case is not a one-off case.  Many people with disabilities get harassed and deprived of their rights and entitlement due to inordinate delay in getting disability certificates.  They are made to go from one hospital to the other despite the fact that the Rights of Persons with Disabilities Act, 2016 and the Rules made thereunder prescribe a time frame of one month from the date of receipt of application for issuing disability certificate and also have provision for penalty for contravention of the provisions of the Act/Rules. 
9.       I am pained to observe that despite my efforts which include convening of a meeting with the officers of Health and Family Welfare Department, Social Welfare Department and all the notified 26 hospitals; recommendations in a number of orders; letters to Secretary, Health & Family Welfare and the Chief Secretary ever since the guidelines were notified by Ministry of Social Justice & Empowerment on 04.01.2018, persons with disabilities and their parents continue to struggle and suffer to get the disability certificates for one reason or the other. I have, on more than one occasion, said that designation and notification of certifying Authorities is a simple task which has no serious technical, medical or legal issue that should require so much time.  It is a matter of serious worry for persons with disabilities and their families that the Health & Family Welfare Department is yet to notify the certifying authorities as per the Rights of Persons with Disabilities Act, 2016 and the Rules of the Central Govt. and GNCT of Delhi. 
10.     In light of the situation brought out above, there is an urgent need for sensitising and issuing strict directions to the officers and other functionaries at all levels for giving due importance to the issues concerning persons with disabilities who happen to be the most marginalized group.  I therefore recommend that Chief Secretary should call a meeting of all the Principal Secretaries, Secretaries, HoDs, Heads of Corporations (North DMC, South DMC, East DMC and NDMC), PSUs and Autonomous Bodies and to sensitise them and direct them to ensure that the provisions of the Rights of Persons with Disabilities Act, 2016 and Rules made thereunder by the Central Govt. and GNCT of Delhi are implemented in letter and spirit. 
11.     I further recommend that the concerned functionaries who deprived Ms. Shruti Sharma of her entitlement for so long by delaying issuance of disability certificate and made her mother and the family to undergo tremendous mental agony and physical stress, should be identified and be asked why penal action should not be initiated against them under the provisions of the Act and the Rules made thereunder.
12.     Action taken on the recommendations may be intimated as required under Section 81 of the Act.
13.     The complaint is disposed off.

Sh. Kapil Kumar Aggarwal, National President of Federation of Disabled Rights filed a complaint dated 09.03.2019 on behalf of Sh. Shivam Goswami, a person with 90 % disability under the Rights for Persons with Disabilities Act, 2016, hereinafter referred to as the Act. The complainant alleged that Sh. Shivam Goswami was issued Railway Concession Certificate on 21.04.2012 and 06.02.2017 by G.B. Pant Hospital. He lost the certificate and therefore approached G.B. Pant Hospital for issuing fresh Railway Concession Certificate. G.B. Pant Hospital directed him to IHBAS, who advised him that the hospital which issued the Disability Certificate should reassess him and issue the Railway Concession Certificate.

2.      The complaint was taken up with the respondents Vide letter dated 19.03.2019 pointing out that persons with disabilities and their families were being harassed by the concerned authorities without appreciating the tremendous trouble such persons with disabilities and their families have to undergo.” and the respondents were directed to submit reply by 01.04.2019. Secretary (Health & Family Welfare) was also advised to issue directions that the hospital / authority which issued the original certificate shall reassess / re-issue the Disability Certificate irrespective of change in jurisdiction.

3.      When no response was received by the due date i.e. 01.04.2019, the complainant was contacted on his given telephone number. He informed that G.B. Pant Hospital has issued the Railway Concession Certificate. Vide letter dated 30.03.2019 Dr. A.K. Mishra, Pr. Consultant in Medicine (HAG), Chairman Disability Certificate Cell, G.B. Pant Hospital also informed that the Railway Concession Certificate has been issued to Sh. Shivam Goswami.

4.      However, a copy of the direction issued to the hospitals / authorities as recommended by this Court has not been received from Deptt. of Health & Family Welfare.

5.      In view of the above, while the complaint is disposed off, it is recommended that Secretary, Deptt. of Health & Family Welfare should issue the Circular as recommended vide order dated 14.03.2019 in case no. 722/1121/2019/02 on priority and inform this Court by 13.06.2019.

              Whereas in mobile court of State Commissioner for Persons with Disabilities held on 30.01.2019 at Shaeed Samarak, Alipur Delhi, Smt. Rekha Thakur mother of  master Anurag Thakur mistakenly mentioned the name of the complainant as master Sandeep Thakur S/o Shri Anurag Thakur instead of Master Anurag Thakur S/o Sandeep Thakur.

2.           And whereas based on the said information in the format of complaint, order dated 30.01.2019 was issued.

3.           And whereas Dr. A.K. Mishra, Pr. Consultant in Medicine (HAG), Chairman Disability Certificate Cell, G.B. Pant Institute of Post Graduate Medical Education & Research (GIPMER), GNCT of Delhi, informed about the above mentioned mistake vide letter dated 23.03.2019 due to which disability certificate could not be issued.

4.           And therefore the said order dated 301.01.2019 is hereby withdrawn and replaced by the following order.

ORDER

              Smt. Rekha Thakur mother of Master Anurag Thakur appeared before the State Commissioner for Persons with Disabilities in the Mobile Court held on 30.01.2019 at Shaeed Samarak, Alipur Delhi. She submitted that master Anurag Thakur has developmental disability. He was being treated for 5 years in GB Pant Hospital. She applied for disability certificate for her son a year ago. However, she was not intimated anything about the certificate. Therefore she stopped going to the hospital. She requested for issuance of disability certificate in respect of her son.

2.           As per Para 21.05 of Notification No. 16/09/2014-DD-III dated 04.01.2018 on assessment and certification of disabilities issued by Department of Empowerment of Persons with Disabilities, the minimum
age of certificate will be one completed year. Children above 1 year and upto age 5 years shall be given diagnosis as Global Development Delay (GDD) Children above age of 5 years shall be given diagnosis and certificate as intellectual disability.

3.           The complainant is directed to report to Director, GBPH by 29.04.2019. Director, GBPH is directed to arrange for assessment and issuance of disability certificate in respect of Master Anurag Thakur, by 20/05/2019. An Action Taken Report be submitted to this Court by 27.05.2019.
