Present : Master Anurag Thakur alongwith his mother Smt. Rekha Thaukur ,
Whereas in mobile court of State
Commissioner for Persons with Disabilities held on 30.01.2019 at Shaeed
Samarak, Alipur Delhi, Smt. Rekha Thakur mother of master Anurag Thakur mistakenly mentioned the
name of the complainant as master Sandeep Thakur S/o Shri Anurag Thakur instead
of Master Anurag Thakur S/o Sandeep Thakur.
2. And whereas based on the said
information in the format of complaint, order dated 30.01.2019 was issued.
3. And whereas Dr. A.K. Mishra, Pr.
Consultant in Medicine (HAG), Chairman Disability Certificate Cell, G.B. Pant
Institute of Post Graduate Medical Education & Research (GIPMER), GNCT of
Delhi, informed about the above mentioned mistake vide letter dated 23.03.2019
due to which disability certificate could not be issued.
4. And therefore the said order dated
301.01.2019 is hereby withdrawn and replaced by the following order.

ORDER
Smt. Rekha Thakur mother of Master
Anurag Thakur appeared before the State Commissioner for Persons with
Disabilities in the Mobile Court held on 30.01.2019 at Shaeed Samarak, Alipur
Delhi. She submitted that master Anurag Thakur has developmental disability. He
was being treated for 5 years in GB Pant Hospital. She applied for disability
certificate for her son a year ago. However, she was not intimated anything
about the certificate. Therefore she stopped going to the hospital. She
requested for issuance of disability certificate in respect of her son.
2. As per Para 21.05 of Notification No.
16/09/2014-DD-III dated 04.01.2018 on assessment and certification of
disabilities issued by Department of Empowerment of Persons with Disabilities,
the minimum
age
of certificate will be one completed year. Children above 1 year and upto age 5
years shall be given diagnosis as Global Development Delay (GDD) Children above
age of 5 years shall be given diagnosis and certificate as intellectual
disability.
3. The complainant is directed to report
to Director, GBPH by 29.04.2019. Director, GBPH is directed to arrange for
assessment and issuance of disability certificate in respect of Master Anurag
Thakur, by 20/05/2019. An Action Taken Report be submitted to this Court by
27.05.2019.
